Public Liability What’s Not Covered?

Public liability insurance does a great job of protecting your business against injury claims, loss or damage claims made by a third party as a result of your negligence, and with most policies that will extend to cover your products (if Broadford or Product Liability is included)
However, there are several common business scenarios where the policy will not cover you.

Faulty workmanship

Property damage claims make up a large percentage of public liability claims, but where that damage is caused by your faulty workmanship, it’s likely to be declined. Some insurers will offer this as an extension to cover for some trades but speak to your broker if you feel that this is a large exposure for your business.

Injury or damage to you or your property

If you as the business owner sole trader or worker are injured as a result of your negligence, your public liability insurance will not respond, this also goes for loss or damage to your property the policy will only cover loss to a third party.
There are a number of income protection, personal accident, or workers compensation options to protect you and your workers, and general property cover may cover for loss or damage to your property, your broker can assist with assessing your risk.

Loss or damage as a result of your professional advice

Doctors, lawyers and even plumbers can cause financial loss as a result of the professional advice they give, this loss is generally excluded in most public liability policies and you or your business may need to consider professional indemnity insurance.

 

Damage or injury as a result of motor vehicle claims

Most registered vehicles, car insurance, truck insurance will include some form of third party liability cover, however your businesses public liability policy will not cover damage or injury as a result of motor vehicle claims.

Whether it’s a death, total and permanent disability, income protection, personal injury claim, worker to worker injury claim or third-party property claim, height is still a Tradies biggest threat.

Safety regulators Australia wide have warned and educated but tradies and workers are still being injured or killed and property is being damaged.

Not just in the construction

It’s not just in the construction industry, its cleaners, electrical workers, plumbing, gas fitting, glazing, tree felling, solar and insulation installation, pest control, handyman work, heating and cooling work and it most often on or in the roof.
Many claims are the result of working on roofs without effective control measure.

Before climbing

Before climbing on a roof;

  • Look at the age of the structure
  • Consider the condition of the structure
  • What type of material is it (Asbestos, fibro etc.)?
  • Where are the important services (power etc.)?
  • Consider environmental factors on the day (wind rain and electrical storms)
  • Angle and pitch of the roof.
  • The presence of moss, contamination and other external factors
  • Consider Ladder Safety procedures
  • Does it require perimeter guards or edge protection or harness protection?

Complacency at Heights

Complacency  is another threat to personnel working at heights, when workers are used to working at heights they often forget the basic, this can result in dropping of tools resulting in property damage or injury. When working at heights, it doesn’t hurt to ask “what if”

Protect you and your workers income

Cover yourself as the self employed tradie with income protection insurance, cover your workers with your States appropriate workers compensation policy and insist that sub-contractors and workers have their income protection insurance.

Protect Property

Make sure you have public liability insurance cover, and that it does not exclude working at heights, and check the asbestos exclusions if the roof contains it.
Make sure your sub-contractors have their own cover and check with your broker to make sure that if they cause injury or property damage that your exposure will be covered.

Overall the Public Liability risk for this occupation is high, although the risk at the premises is fairly limited for scaffold contractors, as there would be few visitors, unless there is a scaffold hire/rent operation on-site. The types of work conducted will affect various exposures. The main risk associated with work at the site/s includes: (a) The risks of materials falling from or being blown from height and cause injury to people or property; (b) Unauthorised access, attractive nuisance; (c) Performance of hot work, smoking; (d) Liability to sub-contractors, vicarious liability for sub-contractors; (e) Damage to customer and other third party property; (f) Business interruptions e.g. from interruption of gas, electricity or water supply; (g) Third party injuries from tools, equipment and materials; and (h) Frequent movement of cranes and material handling equipment and liability for accidents caused by such unregistered mobile machinery/equipment. Construction and other busy work sites present serious risks depending on the relationships between the insured and other tradesmen/contractors on-site. Good risk management of on-site risks is essential. Contract Works insurance will be required for large scale projects. If the insured lease out equipment/scaffold equipment such lease agreement should specify the adequate instruction for customers about how to use such equipment. Scaffolding construction industry is highly regulated. Equipment failure or malfunction could result in serious injury or death and therefore, strict compliance with manufacturer’s instruction is important. Any alteration or misuse of such equipment will increase the exposure. It is important for the underwriter/adviser to establish the details of all major contracts because of the variety of possible work/projects undertaken, as it will give some idea of the potential hazard and exposure.

Wilhelm Harnisch CEO of Master Builders Australia says tradies and builders in the $200 billion building industry are winners from the 2016 Federal Budget. He also says it will have a positive effect on housing affordability.

“The 2016-17 Budget is a win for tradies and Australia’s $200 billion building and construction industry,” Wilhelm Harnisch CEO of Master Builders Australia said.

“This Budget should act to underpin a boost in building industry confidence, through targeted growth measures and a credible budget repair strategy to take Australia into the next decade,” Wilhelm Harnisch said.

“It provides the settings that will enhance the capacity to strengthen the nation’s economic stability, future growth path and greater investment; fundamental requirements for a strong building industry,” he said.

“The various Budget measures will allow the building industry to play a positive role in the rebalancing of the economy,” Wilhelm Harnisch said.

Most insurers offer self-employed clients an income offering that would help if something happened to you and you were unable to work. When calculating your income protection needs you should consider the number of months you could survive without an income before selling off assets or making drastic lifestyle changes. What if I have just started?

Some insurers will offer you a “newly self-employed clause” which means in the event of a claim they will aggregate your income and pro-rata that against your projected income and that will be the monthly benefit.

When starting you can choose an Agreed Value option where your monthly benefit is agreed with you at the time of application and is based on your income at that time. Or Indemnity Value where your monthly benefit is calculated at the time of your claim and is based on your income at that time.

How much cover can you get?

Income protection cover is normally 75% of gross distributable income from the business before tax.

Is proof of income required to claim?

Depending on the insurer and the length of time you have been self-employed most insurers will not ask for proof of income up to $3000 in monthly cover.
