Public Liability Risk for Scaffolders
Overall the Public Liability risk for this occupation is high, although the risk at the premises is fairly limited for scaffold contractors, as there would be few visitors, unless there is a scaffold hire/rent operation on-site. The types of work conducted will affect various exposures. The main risk associated with work at the site/s includes: (a) The risks of materials falling from or being blown from height and cause injury to people or property; (b) Unauthorised access, attractive nuisance; (c) Performance of hot work, smoking; (d) Liability to sub-contractors, vicarious liability for sub-contractors; (e) Damage to customer and other third party property; (f) Business interruptions e.g. from interruption of gas, electricity or water supply; (g) Third party injuries from tools, equipment and materials; and (h) Frequent movement of cranes and material handling equipment and liability for accidents caused by such unregistered mobile machinery/equipment. Construction and other busy work sites present serious risks depending on the relationships between the insured and other tradesmen/contractors on-site. Good risk management of on-site risks is essential. Contract Works insurance will be required for large scale projects. If the insured lease out equipment/scaffold equipment such lease agreement should specify the adequate instruction for customers about how to use such equipment. Scaffolding construction industry is highly regulated. Equipment failure or malfunction could result in serious injury or death and therefore, strict compliance with manufacturer’s instruction is important. Any alteration or misuse of such equipment will increase the exposure. It is important for the underwriter/adviser to establish the details of all major contracts because of the variety of possible work/projects undertaken, as it will give some idea of the potential hazard and exposure.
